Consumer Health Data Privacy Policy

This notice supplements the FitnX Privacy Policy and applies where consumer-health-data laws require it.

1. Who we are

FitnX is operated by Gellért Dániel individual entrepreneur, 2336 Dunavarsány, Erkel Ferenc utca 24., Hungary. Contact developersensey@gmail.com.

This separate notice supplements the Privacy Policy, including for Washington residents and people whose consumer health data is collected in Washington under the Washington My Health My Data Act, and for Nevada residents under applicable Nevada consumer-health-data law.

2. Consumer health data collected

Depending on features you choose, FitnX may collect:

  • birth date, selected gender, height, weight and body-measurement history;
  • workouts, exercises, repetitions, resistance, duration, notes and activity history;
  • heart rate, energy, distance, speed, pace, cadence, elevation, laps and sensor samples;
  • precise location and routes during user-started route tracking;
  • data imported from Apple Health/HealthKit or Android Health Connect;
  • workouts and metrics received from Apple Watch or Wear OS; and
  • statistics, trends, scores and other information derived from the above.

3. Sources

Data comes from you; your phone and paired watch sensors; Apple Health/HealthKit or Android Health Connect when authorized; Google or Apple sign-in for account information; and calculations performed from your stored activity data.

4. Why it is collected and used

We use consumer health data only to provide features you request: recording and restoring activities, synchronizing a diary, showing routes, calculating fitness statistics and trends, supporting exports/imports, enabling device continuity, providing support and maintaining security. We do not use it for targeted advertising, data brokerage, credit, insurance or employment decisions.

Collection and use are limited to what is necessary to provide a requested product or service or covered by your affirmative consent where applicable. New categories or materially new purposes require advance disclosure and consent when the law requires it.

5. Sharing

FitnX does not sell consumer health data. It does not share it for advertising. Necessary processing may involve:

  • Google/Firebase, which hosts and synchronizes account, workout, route and support data;
  • Apple Health/HealthKit or Android Health Connect when you request import/export;
  • a paired Apple Watch or Wear OS device for activity recording and results;
  • MapTiler when you request a route map; map-tile coordinates can reveal the approximate displayed area, although the saved raw route is not sent as a separate payload; and
  • authorized support, security, legal or infrastructure personnel and providers strictly as necessary.

RevenueCat receives subscription identifiers and entitlement information, not workout, body-measurement or route content. Apple and Google independently process store and platform data under their own notices.

6. Rights

Subject to applicable law, you may:

  • confirm whether we collect, share or sell your consumer health data;
  • access the data and receive information about recipients;
  • withdraw consent for future collection or sharing;
  • request deletion, including notification to relevant processors and recipients;
  • appeal a refusal of a request; and
  • authorize an agent to act for you, subject to verification.

Use in-app controls or email developersensey@gmail.com. We may verify identity using the existing account or proportionate information. You do not need to create a new account to make a request. We will not discriminate for exercising rights.

If we deny a request, you may appeal by replying with the subject Privacy appeal and explaining why the decision should be reconsidered. We will respond within the period required by applicable law and explain any regulator complaint route.

Optional location, health-platform and telemetry permissions can be withdrawn in FitnX or device settings. Withdrawal stops future access or processing based on that permission but does not automatically delete data already imported or recorded. Use deletion controls or submit a deletion request for existing FitnX data.

8. Sale and geofencing

FitnX does not sell consumer health data and therefore does not request a sale authorization. FitnX does not implement geofences around health-care facilities to identify or track people, collect consumer health data or send health-related advertisements.

9. Security and retention

We apply measures described in the Privacy Policy, including authenticated access, owner-scoped rules and encrypted transport. Consumer health data follows the same retention periods as the corresponding FitnX profile, workout, activity, location or local-device data. Account deletion removes active app-owned consumer health data, subject to legally required records and temporary isolated backups.

10. Changes and contact

We will not collect or share additional categories of consumer health data or use it for additional purposes without the disclosure and consent required by applicable law. Material changes will be posted with an updated date.
